In recent documents filed by John Durham, it is alleged the CIA concluded data from Clinton campaign lawyer Michael A. Sussmann alleging coordination between Donald Trump and Russia was "not technically plausible" and was "user-created.
Filed on 4/15/2022 Durham responded to objections from Sussmann’s defense regarding what evidence could be admissible at trial, which is scheduled to begin next month.
Sussmann is accused of lying to the FBI by saying he was not attending a meeting on behalf of a particular client, when he was actually presenting the information on behalf of the 2016 Hillary Clinton presidential campaign. He is charged with a single count of making a false statement to the FBI in connection with his assertion that he was not acting on behalf of any Democratic Party-tied client.
In this filing, Durham responded to the evidence that Sussman's legal team were
attempting to keep from the jury. Durham responded point by point why the evidence should be heard. In the 42 page document that can be found here, he lists out the reasons why the government needs to present this evidence. And claimed without evidence, the jury would be hearing information in a vacuum without reference.
The evidence according to Durham is that Sussman while working for the Clinton campaign approached both the CIA, and the FBI and presented evidence (later determined by the CIA to be false) that there was a connection between a Russian bank and Trump tower. If the FBI did not act on this information, he was going to take the information to the media. Which he ultimately came thru on his threat.
The most important takeaway in Durhams filing is where he states, "defense counsel is not – and could not be – aware of all the evidence that the Government has collected and continues to collect, or of the possible violations of law it is investigating.
