As businesses and consumers flee from highly regulated and taxed states to those states that are more business and family-friendly, Congress has seized the opportunity to punish those states. In a 6th Covid stimulus bill, inserted at the last minute, Congress has made a provision that basically prohibits states from cutting taxes between now and 2024. This last-minute provision eviscerates the state's ability to set its own policy on taxation.
While Congress may put conditions on funding, it may NOT exceed the authority of the state to conduct business as they see fit. This provision of the Covid relief bill is essentially a takeover of states' authority to self-govern and put control of taxation policy into the hands of DC.
"A State or territory shall not use the funds provided under this section or transferred pursuant to section 603(c)(4) to either directly or indirectly offset a reduction in the net tax revenue of such State or territory resulting from a change in law, regulation or administrative interpretation during the covered period that reduces any tax (by providing for a reduction in a rate, a rebate, a deduction, a credit or otherwise) or delays the imposition of any tax or tax increase."
States are fighting back against this unconstitutional measure. Ohio's attorney general Dave Yost was the first to file a lawsuit against the Biden administration's "unconstitutional attempt to commandeer state taxing authority". Thirteen additional states have filed for injunctive relief against the takeover.
It is a taxing situation with both the House and Senate are under the control of Democrats, who wish to fundamentally transform the United States into a more Socialistic society, but also the White House that has spent an enormous amount of time writing executive actions that have killed jobs usurped American energy sovereignty, and has yet to deal with the crisis on the southern border. A crisis that the sitting president created while he was campaigning for president.
Today Biden ordered a study of adding justices to the Supreme court. If he is successful in his endeavor, the supreme court will become the most powerful legislative body. It has the potential to be a branch of the Democratic party.
The freedoms we currently enjoy such as free speech, owning firearms, will be interpreted in a more popular culture style of government. Transforming the court will give the democratic party full authority over the lives of Americans.
While many Americans vehemently oppose this legislation there are people who are applauding Biden's actions. As senator Amadalla on the sci-fi movie Star Wars said, "so this is how democracy dies, with thunderous applause."
I’m glad various states are already suing the Biden Administration over this. The more media coverage this gets, along with the negative consequences will encourage vulnerable Democrats to argue against their own party and President as we approach the midterm elections.
