Despite the failed amendment vote that sparked outrage across the country, the final version of the bill still includes a ban on Medicaid benefits for illegal immigrants—including those convicted of serious crimes.
Senator Eric Schmitt confirmed this, pointing directly to Section 77109 on page 602 of the legislation. The language amends Title XIX of the Social Security Act to ensure that no medical assistance is provided under Medicaid to individuals not lawfully admitted for permanent residence, except for emergency services.
So what happened?
The Cornyn amendment, which would have penalized states for offering broader benefits, failed due to a 60-vote threshold.
But the core ban on Medicaid for illegal immigrants remains intact in the final bill.
That means states cannot use federal Medicaid dollars to cover illegal immigrants, except in emergencies.
This is a critical distinction—and one the media is likely to blur. So let’s be clear: the fight isn’t over, but this provision survived.
